Federal Court Mandates Freedom of Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks legal authority.
"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The situation originates in a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an error. After his repatriation to the United States to answer human smuggling allegations, he was held in federal detention.
In her decision, the court pointed out that the government does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

The court proceedings involve conflicting claims. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.
